These Terms of Service ("Terms") govern your use of mcoutdoorservicesnj.com (the "Site") and the landscaping and hardscaping services provided by M&C Outdoor Services ("M&C," "we," "us," or "our"). By using our Site or booking our services, you agree to these Terms.

1. Who we are

M&C Outdoor Services is a residential and commercial landscaping and hardscaping company based in Scotch Plains, New Jersey, serving Union, Somerset, Morris, and Middlesex County and the surrounding areas.

2. Services we provide

We offer residential and commercial landscaping and hardscaping services, including paver installation, patio installation, irrigation system installation and maintenance, landscaping, and mulching. Specific service availability and pricing depend on your location, the condition of the property, and the scope of work.

3. Quotes and pricing

How quotes work. We provide free quotes based on the information and photos you provide and an on-site assessment where needed. Each quote stays valid for the period stated on the quote itself.

What changes the price. Final pricing may change from the initial quote if the work scope changes, if access is more difficult than indicated, if the property condition differs significantly from the photos provided, or if additional services are added at your request. We will discuss any pricing changes with you before performing additional work.

Payment terms. Payment is due upon completion of the service unless you have an established account or recurring contract with different terms. We accept credit cards, ACH bank transfers, and checks.

Late payments. Overdue invoices may be subject to a late fee as noted on your invoice.

4. Scheduling and cancellation

Scheduling. All services are scheduled by mutual agreement. We will confirm the date and time with you in advance.

Weather. We reserve the right to reschedule services due to weather conditions that affect work quality or safety. We will text you the day before to confirm or reschedule.

Customer cancellations. You may reschedule or cancel a booked service in advance at no charge. Cancellations made on short notice, after our crew has been dispatched, may be subject to a trip fee.

No-shows. If our crew arrives at the scheduled time and cannot access the property or perform the work, a trip fee may apply.

5. Our work and your responsibilities

What we do. We perform the services described in the quote using our own equipment, materials, and crew. We carry general liability and workers' compensation insurance. Proof of insurance is available on request.

What you do. You agree to:

  • Provide access to the work area and, where needed, an outdoor water source and power outlet
  • Mark or disclose the location of underground irrigation lines, invisible pet fences, low-voltage wiring, septic systems, wells, and any other private lines not identified by the public utility mark-out service
  • Move vehicles, outdoor furniture, and personal items away from work and staging areas
  • Inform us of delicate plantings, irrigation heads, lighting, or other features requiring special care
  • Inform us of any pre-existing damage or conditions on the property before we begin
  • Confirm that you are authorized to request work on the property and obtain any HOA or municipal approvals that may be required

Things we are not responsible for: damage to undisclosed or unmarked private underground lines (such as irrigation, low-voltage wiring, or pet fencing), pre-existing drainage or grading problems, natural settling or movement of pavers and materials over time, or plant and turf loss due to weather or conditions outside our control.

6. SMS and text messaging terms

By providing your phone number to M&C Outdoor Services, you consent to receive text messages from us related to your service.

Types of messages we send: Quote confirmations, appointment confirmations and reminders, service updates, replies to your questions, and occasional promotional offers (only if you separately opt in).

Message frequency: Message frequency varies. Most customers receive fewer than 10 messages per service.

Message and data rates may apply depending on your wireless plan.

To opt out at any time: Reply STOP to any message. You will receive a confirmation that you have been unsubscribed.

Privacy of SMS data. We do not share, sell, transfer, or otherwise disclose your phone number, SMS opt-in information, or consent data to any third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for more details.

7. Insurance and damage claims

Our insurance. We carry general liability and workers' compensation insurance. A certificate of insurance is available on request, and is typically provided before the first job for commercial accounts.

Damage claims. If you believe M&C Outdoor Services caused damage during the course of work, notify us promptly after the service date. We will investigate promptly and, where the damage was caused by our work and was not the result of pre-existing conditions, we will repair or replace the affected item at no cost to you, or refer the claim to our insurance.

Limitations. M&C Outdoor Services is not responsible for damage caused by pre-existing conditions, including but not limited to undisclosed underground utilities or irrigation lines, pre-existing drainage or grading problems, unstable or undisclosed soil and sub-base conditions, and undisclosed delicate plants or landscaping.

8. Guarantees

If you are not satisfied with the quality of our work, contact us and we will return to the property to address any issues at no cost to you. This guarantee applies to the original scope of work and does not extend to work that was not part of the quoted service.

9. Limitation of liability

To the maximum extent permitted by law, M&C's total liability to you for any claim arising from or related to our services is limited to the amount you paid us for the specific service giving rise to the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or property value loss.

This limitation does not apply to gross negligence or willful misconduct, and does not affect any rights you have under applicable law that cannot be limited or waived.

10. Indemnification

You agree to indemnify and hold M&C Outdoor Services harmless from any claims arising from your breach of these Terms, your use of the services in a way not permitted by these Terms, or your provision of false information when requesting service.

11. Use of our website

By using mcoutdoorservicesnj.com, you agree not to:

  • Attempt to gain unauthorized access to the site or its systems
  • Use the site to transmit malicious code or content
  • Scrape or copy our content for use on other sites without permission
  • Misrepresent your identity when contacting us

We reserve the right to refuse service or terminate access to the site for any user who violates these terms.

We encourage you to contact us first to resolve any concerns informally before pursuing legal action. Most issues are resolved with a phone call.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
